Terms and Conditions

  1. The competition is conducted by OOMPH! Network, ABN 47 944 286 383 of 10 Cabernet Court, South Frankston, Vic 3199 (Promoter) www.oomphnetwork.com

  2. Information on how to enter and the prize form part of these Conditions of Entry. Entry into this competition is deemed acceptance of these Conditions of Entry by each entrant.

  3. This competition is open to residents of Australia.

  4. This competition will commence at 09:00 AEST on 9th October 2019 and all entries must be received by 23:59 AEST on 21st November 2019. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter by the closing date for any reason. Entries via agents or third parties are invalid.

  5. Entrants may submit as many entries as they wish.

  6. No purchase is necessary to enter the competition.

  7. To enter, entrants must

    1. post a photo or video as an Instagram post

    2. hashtag #OOMPHGiveaway and tag @OOMPH.Media in the caption of the post

    3. Repost the competition details image posted on the promoters Instagram page to their story including the hashtag #OOMPHGiveaway and tag @OOMPH.Media

    4. follow @OOMPH.Media on Instagram

    5. have their profile set to public

  8. Entrants must remain following @OOMPH.Media on Instagram for the duration of the promotional period to be eligible to claim any prize.

  9. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with this competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.

  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. The Promoter reserves the right to request the entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the entrant's identity, age, residential address, eligibility to enter and claim a prize. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  12. By entering this competition each entrant confirms that his/her entry is their wholly owned creation and, to the extent that such entry makes use of any third-party materials, that these have been fully cleared unless they are no longer protected by copyright or other intellectual property rights.  Entrants indemnify the Promoter against any claims in relation to their entry that the entry infringes the personal or proprietary right of any other person.  By submitting an entry, each entrant grants to the Promoter a perpetual, royalty-free, non-exclusive licence to edit, publish, translate, modify, adapt, make available and distribute the entry throughout the world in any media now known or hereafter invented. 

  13. Each entrant also confirms that anyone depicted in an entry has given their permission for the inclusion of their image in the entry and the use of the entry including their image by the entrant and the Promoter.

  14. The Promoter will use any data submitted by entrants only for the purposes of running the competition, unless otherwise stated in the entry details. By entering this competition, all entrants consent to the use of their personal data by the Promoter for the purposes of the administration of this competition and any other purposes to which the entrant has consented.

  15. An entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter's Privacy Officer. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected can be found at www.oomphnetwork.com

  16. Any cost associated with accessing Instagram or the competition website is the entrant's responsibility and is dependent on the Internet service provider used.

  17. One winner will be selected by a vote of skill for the most creative entry. Winners will be notified via a direct message through OOMPH Media Instagram on 22nd November 2019. The winner’s Instagram handles will be published on OOMPH! Media Instagram account and OOMPH Media website on 22nd November 2019. All reasonable steps to notify the winner of the results of the selected winners will be taken by the Promoter.  

  18. Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.

  19. Winners must claim their prize within 3 days of the Promoter sending notification. If the prize is unclaimed after this time, it will lapse, and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules.

  20. The Prize for the winner is as follows

    1. 2 hour pre production concept session with the director

    2. Pre production valued at $450

    3. 2 day music video shoot, including 1 Director, Producer,1st AC and OOMPH!’s full inventory of video and lighting equipment, valued at $3700

    4. up to 1 day of post production valued at $550

  21. The following conditions are applicable to the prize

    1. The winner must agree to the standard OOMPH! Production agreement, and abide by all terms in the agreement in addition to the terms set out in this competition.

    2. The artist will have the opportunity to present their ideas and concepts for the music video. However it will be at the promoters discretion to make final creative choices to ensure quality and artistic merit.

    3. Total prize pool valued at $4700

    4. The music video will be shot in Melbourne and surrounding suburbs, in locations deemed appropriate by the promoter. The winner must make their way to the locations at their own expense.

    5. The prize does not include any additional costs, including but not limited to wardrobe, makeup, talent, additional lighting and camera equipment hire, locations, set, props and travel. If the winners video concept requires additional costs, these are the responsibility of the winner and are not included in the prize.

    6. If the winner does not claim all or part of their prize they forfeit that prize indefinitely.

    7. In consideration for the Promoter awarding a prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter and its advertising and marketing activities, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
